I am writing to you today regarding reopening and re-examining the Rosenberg Case. Although it has been almost 50 years since Julius and Ethel Rosenberg were executed for conspiracy to commit espionage, this case still stands as the most dramatic miscarriage of justice which occurred during a time of turmoil in our nation's history.
1
The impact and interest in the Rosenberg Case is very strong today; and the issues raised by what happened then are timeless. In the Fall and Winter of 2001, the Rosenberg Case was featured on a nationally televised program, CBS' 60 Minutes II; and in an exhibit at the New York Historical Society. The turnout for the exhibit was so great that it has been held over for three  months. In addition, two new books were published concerning the Rosenbergs. In one of them, The Brother, by Sam Roberts of the New York Times, a key witness in the case admits to perjuring himself during the trial; and relates that he was encouraged to do so by the prosecution. without this testimony the executions may very well may not have taken place.

The admission of perjury by the key witness in the Rosenberg Case (in print and on television) is a powerful inducement to consider review. Other injustices in this case, many of which are documented by FBI files obtained through the Freedom of Information Act, include: additional instances of perjured testimony, ex parte communication between the prosecution and the trial judge, interference with the appellate process, and collusion between the Attorney General of the United States and the Chief Justice of the Supreme Court to overturn a stay of execution by one of its justices. This was the only time in the history of the Supreme Court that a stay had been overturned.

In the aftermath of the 9/11 bombings, concerned Americans everywhere wish to know that our government is taking the steps necessary to ensure our safety. At the same time it is essential to guarantee that the human rights of every individual citizen and all ethnic groups are being protected. The paranoia and hysteria which ruled the political landscape of the 50's, and was one of the most important factors in the conduct and terrible outcome of the Rosenberg Case, must be safeguarded against in the times ahead as we continue to wage the war against terrorism.
4
The Rosenberg Case is an open wound upon the body of the American justice system. What better way to address some of the difficult issues at hand and strengthen the confidence of American citizens in our government than by re-examining this case?  By openly discussing the case and demonstrating the resolve to never let such a thing happen again, we truly can create a stronger country of which we can be proud. And perhaps just as importantly, we send a message to the world that the United States is unafraid to clean its own house as it takes the steps necessary to continue to be a leader fighting for the democratic rights of all people worldwide.
